Iraq Embassy Legalization | Power of Attorney Power of Attorney is a legal term used as a reference to a document issued by a legal person called (the Client), authorizing someone else called (the Agent) to act on his behalf and exercise all his rights in a certain matter or in general.
There are two main types of Power of Attorneys:-
First:
General Power of Attorney General Power of attorney is issued by the Client to empower the Agent to act on his behalf in all his granted rights customarily, legally, and religiously. In other words, it entitles the Agent the right of dispose in all Clients’ property. US Arab Chamber of Commerce does not recommend this type of powers as it authorizes the Agent the dispose freedom in everything and without any time limit.
Second:
Special Power of Attorney Special Power of Attorney entitles the Agent the dispose right in a certain issue for a specific time limit mentioned in the Power. Iraqiembassy offers different forms of the most common types of Special Powers of Attorney that often used in Iraq:
1. Power of Attorney for litigation It assigns the Agent the right to act on behalf of the Client in all Iraqi courts, including his rights to file lawsuits. It must state a specific time line.
2. Power of Attorney for Pension It empowers the Agent the right to review General directorate of Retirement and the Iraqi Board of Pension. It must include a time line.
3. Power of Attorney for Nationality Affairs It assigns the Agent to act on behalf of the Client in the Iraqi Civil Status Directory for a specific period.
4. Power of Attorney for Sale It designates the Agent the right to exercise his rights regarding the selling of properties. It must state a time period.
